Kincast is designed to be a "private first" video and digital media web service. Our working assumption is that families value their privacy. All videos and digital media on Kincast start out as private and can be optionally shared. We are passionately committed to ensuring the privacy of our customers.
This Privacy Policy (this "Policy") describes how personal information is collected from users of Kincast's website at www.Kincast.com (the "Site"), and how that information is used and disclosed.
By using our Site, you consent to the terms of this Policy.
Your Content and Data
We respect the privacy of our customers and the privacy of their content (videos, photos, other digital media) and data. All user information is governed by our Terms of Service. Although Kincast owns the content and data storage, databases and the Site, you retain all rights to your content and data.
What We Collect
We collect the email addresses and certain personally identifiable information of those who communicate with us via email or register with us to open an "Account". We also collect certain aggregate information regarding which pages users access or visit, and information volunteered by the users (such as any surveys Kincast might conduct and/or site registrations).
When you register on the Site, we ask for the following information: your email address and password. Those who sign up for a premium, paid subscription are required to enter a name, billing address and credit card number. Users who pay Kincast with Amazon Simple Pay do not need to provide Kincast with any billing information. Users of the Site also have the option to provide a friendly name that identifies them to people they are sharing content with.
When you submit information, you are transferring such information into the United States and you hereby consent to such transfer.
Kincast may also collect and analyze from visitors and users certain information regarding the use of the Site and services available therein. Information collected may include but is not limited to web site traffic volume, frequency of visits, type and time of transactions, type of browser and operating system, etc.
Use of Information
We may use personal information to provide the Services you’ve requested. We may also use personal information for auditing and research and analysis to operate and improve Kincast. We may use third parties to assist us in processing your personal information, and we require that such third parties comply with our Privacy Policy and any other appropriate confidentiality and security measures. We may use certain other information collected from you to help diagnose technical problems, administer the Site, and improve the quality and types of services delivered. We may provide non-identifying and aggregate usage and volume statistical information derived from the actions of our visitors and account holders to third parties in order to demonstrate the value we deliver to users.
The information we collect is not shared with or sold to other organizations for commercial purposes, except to provide products or services you’ve requested, when we have your permission, or under the following circumstances:
- if it becomes necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of the Terms of Service, or as otherwise required by law; or
- if Kincast is acquired by or merged with another company. In this event, Kincast will notify you before information about you is transferred and becomes subject to a different privacy policy.
Cookies & Web Beacons
Cookies are small files that are stored on your computer by your browser at the request of a web site to store your personal preferences. We use cookies to keep you logged in to the Site, to count the number of unique computers visiting the Site, and to record your user preferences.
Web beacons (also known as clear gifs, pixel tags or web bugs) are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users or to access cookies. Unlike cookies which are stored on the user’s computer hard drive, web beacons are part of a web page or email. Otherwise, it is used in the aggregate only. The Site may contain links to other Web sites. Links from our Site to other sites or content are provided for your convenience only, and we do not have control over the content or privacy and security practices and policies of such third parties or other sites. Any personal information you provide on linked pages is provided directly to that third party and is subject to that third party's privacy policy. Security
We have put into place reasonable security measures in an effort to prevent loss, misuse and alteration of information while it is under our control. We cannot, however, guarantee the protection of information against interception, misappropriation, misuse or alteration, nor can we promise that your information may be not be disclosed or accessed by accidental circumstances or by the unauthorized acts of others. Furthermore, we have no control over the security of other sites you might visit, interact with or do business with.
When you register for an account on the Site, we ask you to create a password. To protect the confidentiality of your personal information, you must keep your password confidential and not disclose it to any other person. You are responsible for all uses of the Site by any person using your password. Please advise us immediately if you believe your password has been misused or otherwise misappropriated.
Cancellation or Termination of the Account
If you choose to cancel your Account and leave the Kincast Service or your Account is terminated because of your breach of the Terms of Service, please be aware that Kincast may for a time retain residual information in our backup and/or archival copies. We will make reasonable commercial efforts to delete your information as soon as reasonably practical.
Use of our Site by Children
This Site is not designed or intended to collect and retain personal information from children who are under 13 years of age, and you must be 18 years of age or older to create an account on the Site.
Policy Changes
We will modify this Policy if our privacy practices materially change in the future and we will notify you of such changes by posting the modified Policy on our Site and indicating at the top of the Policy the date it was last updated and possibly sending a notice to the primary email address specified in your Account.
